This Content Submission Policy governs the submission of photographs, videos, stories, text, audio, and other materials (“Media” or “Submissions”) to Zachary’s Jewelers.

By submitting Media, you acknowledge that you have read, understood, and agree to be legally bound by this policy.

Overview

Submitted Media may be considered for use in:

  • The Zachary’s Jewelers website and blog
  • Social media platforms
  • In-store digital displays
  • Printed publications
  • Advertising and marketing campaigns
  • Email marketing
  • Press or media promotion
  • Other promotional, editorial, or marketing materials

Submission does not guarantee use or publication.

Eligibility

By submitting Media, you represent and warrant that:

  • You are at least 18 years of age
  • You have the legal authority to enter into this agreement
  • All information provided is truthful and accurate

If your submission includes another individual, you confirm that you have obtained their permission to submit the Media and grant the rights described in this policy.

Ownership and Rights

You represent and warrant that:

  • You own the Media or have obtained all necessary rights and permissions
  • The Media does not infringe on any copyright, trademark, privacy, or publicity rights
  • The Media does not violate any agreement with photographers, videographers, or other third parties
  • All individuals appearing in the Media have consented to its use

Zachary’s Jewelers relies on these representations when accepting submissions.

Photographer and Creator Permissions

If submitted Media was created by a professional photographer, videographer, or production studio, you represent and warrant that you have obtained permission or a valid license for its use.

Zachary’s Jewelers does not verify these permissions, and responsibility rests entirely with the submitting individual.

License Granted

By submitting Media, you grant Zachary’s Jewelers and its affiliates a:

Perpetual, irrevocable, worldwide, royalty-free, transferable, sublicensable, non-exclusive license to:

  • Use
  • Publish
  • Reproduce
  • Display
  • Distribute
  • Edit
  • Adapt
  • Archive
  • Create derivative works

This includes use in all marketing, promotional, editorial, and commercial contexts.

Zachary’s Jewelers may use submitted Media in whole or in part, with or without modification, at its sole discretion.

No compensation will be provided for submitted Media.

Name, Image, and Likeness Release

You grant Zachary’s Jewelers the right to use the name, likeness, image, voice, and identity of any individuals appearing in submitted Media.

You represent that all individuals have consented to this use.

Waiver of Moral Rights

To the fullest extent permitted by law, you waive any moral rights in the submitted Media, including rights of attribution or integrity.

Zachary’s Jewelers may edit, crop, or modify Media at its discretion.

No Obligation to Publish

Zachary’s Jewelers is not obligated to publish or use any submitted Media.

We reserve the right to:

  • Select or reject submissions
  • Edit or modify submissions
  • Use only portions of submissions
  • Remove previously published content

Responsibility for Submissions

You acknowledge that:

  • You are solely responsible for the Media you submit
  • Zachary’s Jewelers does not verify ownership or permissions
  • We rely on your representations regarding rights and permissions

Indemnification

You agree to defend, indemnify, and hold harmless Zachary’s Jewelers and its affiliates from any claims, damages, or expenses arising from:

  • Copyright or trademark infringement
  • Violation of privacy or publicity rights
  • Failure to obtain required permissions
  • Any breach of this policy
  • Any third-party claim related to submitted Media

This obligation survives removal of the Media.

Limitation of Liability

To the fullest extent permitted by law, Zachary’s Jewelers shall not be liable for any indirect, incidental, or consequential damages arising from submitted Media or its use.

Copyright Complaints (DMCA)

If you believe content infringes your copyright, you may submit a notice including:

  • Identification of the copyrighted work
  • Identification of the allegedly infringing material
  • Your contact information
  • A good-faith statement that the use is not authorized
  • A statement, under penalty of perjury, that the information provided is accurate

We may remove or disable access to content upon receiving a valid notice.

Dispute Resolution

Any dispute arising from this policy shall be resolved through binding arbitration, except where prohibited by law.

Arbitration shall take place in the State of Maryland in accordance with applicable rules.

Class Action Waiver

All disputes must be brought on an individual basis and not as part of any class or representative action.

Governing Law

This policy is governed by the laws of the State of Maryland.

Entire Agreement

This policy constitutes the entire agreement regarding submitted Media and supersedes any prior agreements or communications.
